1. Acceptance of Terms

By accessing and using tempo ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. The Service is available via web browser and mobile applications (iOS and Android). These terms apply to all platforms.

2. Eligibility

You must be at least 13 years old to use the Service. By using tempo, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. Account Registration

To access certain features of the Service, you must create an account. You may register using:

• Email and password
• Spotify account (OAuth)
• Apple ID (on iOS devices)
• Google account (on mobile devices)

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration.

4. Access and Waitlist

Access to tempo may be subject to a waitlist system. New users may need a referral code from an existing user to gain full access. Referral codes are subject to usage limits and may be deactivated at any time. We reserve the right to modify access requirements without notice.

5. Use License

Permission is granted to access and use the materials on tempo's website and mobile applications for personal, non-commercial use. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials except as permitted
• Use the materials for any commercial purpose or public display
• Attempt to reverse engineer any software contained on tempo
• Remove any copyright or other proprietary notations from the materials
• Use automated systems, bots, or scrapers to access the Service

6. User Content

You retain ownership of any content you create on tempo. By posting content, you grant tempo a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the Service. User content includes:

• Reviews of shows, albums, and songs
• Photos and videos uploaded to reviews
• Comments on reviews and feedback
• User-created lists and collections
• Profile information (bio, avatar, display name)
• Feature requests and feedback submissions

You agree not to post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or violates any third party's rights.

7. Third-Party Services

tempo integrates with third-party services to enhance your experience. By connecting these services, you authorize tempo to access certain data as described in our Privacy Policy:

• Spotify: Access to your top artists and listening data to personalize your experience
• Apple Music: Access to your listening history and top artists

Your use of these third-party services is also subject to their respective terms of service and privacy policies. You may disconnect these services at any time through your account settings.

8. Social Features

tempo includes social features that allow you to interact with other users:

• Following and being followed by other users
• Liking reviews and lists
• Commenting on reviews
• Creating and sharing lists of reviews
• Sharing review cards on external platforms
• Blocking users you do not wish to interact with
• Reporting users, reviews, or comments that violate guidelines

You agree to use these features responsibly and in accordance with our Community Guidelines.

9. Badges and Achievements

tempo awards badges for various achievements and milestones. Badges are earned based on your activity and are for display purposes only. We reserve the right to modify, revoke, or discontinue the badge system at any time. Attempting to artificially inflate your activity to earn badges may result in badge removal or account suspension.

10. Notifications

By creating an account, you agree to receive notifications related to your account activity, including likes, comments, follows, and badge achievements. You may customize your notification preferences or opt out of non-essential notifications in your account settings. We may still send you important service-related communications.

11. Prohibited Uses

You may not use the Service:

• In any way that violates any applicable law or regulation
• To transmit any malicious code or viruses
• To impersonate or attempt to impersonate another user
• To engage in any automated use of the system, including bots or scrapers
• To harass, abuse, or harm other users
• To post fake or fraudulent reviews
• To manipulate ratings, likes, or follower counts through artificial means
• To share or sell referral codes for commercial purposes
• To circumvent the waitlist or access control systems
• To collect or harvest user data without authorization

12. Content Moderation

We reserve the right to review, moderate, and remove any content that violates these Terms or our Community Guidelines. We may, but are not obligated to, monitor user content. Users can report content that they believe violates our policies.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms of Service, our Community Guidelines, or is harmful to other users, us, or third parties. Grounds for termination include, but are not limited to:

• Violation of these Terms or Community Guidelines
• Harassment or abuse of other users
• Posting fraudulent or fake content
• Illegal activity
• Creating multiple accounts to evade bans

You may delete your account at any time through your account settings.

14. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by tempo and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Artist names, venue names, and festival names displayed on the Service belong to their respective owners.

15. Disclaimer

The materials on tempo are provided on an "as is" basis. tempo makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

User reviews and content represent the opinions of individual users and do not represent the views of tempo. We do not guarantee the accuracy, completeness, or usefulness of any user-generated content.

16. Limitations

In no event shall tempo or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on tempo.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
